Terms of service for 9o.pl
Effective from [date]. These terms govern the use of the service and form the contract between you and the provider.
1. Provider and subject matter
The provider is Tomasz Benert, Trachslauerstrasse 6B, 8840 Einsiedeln, CH, e-mail admin@9o.pl. The service creates images from a text description using external artificial intelligence models.
2. Account
Use requires an account with a valid e-mail address. The account is personal and must not be shared with third parties. The service is intended for persons aged 16 and over; persons with limited legal capacity require the consent of their legal guardian. You may delete your account at any time.
3. Credits and payment
- The service works on a prepaid basis: you top up a balance, and each image creation reduces it by the amount shown before you click.
- Credit does not expire and is not paid out in cash. It is not a means of payment and can only be used within this service.
- Payments are handled by PayPal. An invoice is issued on request to admin@9o.pl.
- Prices shown include applicable taxes. We reserve the right to change prices for the future; credit already topped up retains its value.
4. Right of withdrawal (for consumers)
You may withdraw from the contract within 14 days without giving reasons; a message to admin@9o.pl is sufficient.
Important exception: the right of withdrawal ceases for a service that has been fully performed with your express consent and with your acknowledgement that you thereby lose your right of withdrawal. You give this consent by creating an image. This means: no refund is available for images already created. Unused credit is refunded within 14 days via the same payment method.
5. Rules of use – prohibited content
You undertake not to create or use images that
- depict sexual content involving minors or sexualise minors in any way,
- show realistic depictions of specific, identifiable people without their consent, in particular for the purpose of deception (so-called deepfakes),
- incite violence, hatred or discrimination, or glorify terrorism or totalitarian ideologies,
- infringe copyright, trade marks or other third-party rights,
- serve disinformation, fraud or other criminal purposes.
Breaches entitle us to block the account without warning. The AI providers apply their own filters and may reject a description – such a rejection is not a defect of the service.
6. Rights in the created images
You may use the created images freely, including commercially, within the limits of section 5. Please note: images generated purely by artificial intelligence may not be protected by copyright – we cannot grant you exclusivity, and similar images may be created by other users. We do not warrant that an image does not infringe third-party rights; you are responsible for how you use it.
7. Availability, storage and changes
We aim for high availability but do not owe uninterrupted operation. The service relies on external providers whose outage or change of offering may temporarily limit functionality. Images are kept for the period stated in the service (30 days by default) and then deleted – download whatever you want to keep. The service is not a backup.
8. Complaints
Send complaints to admin@9o.pl; we handle them within 14 days. If an image could not be created for reasons within our responsibility but your balance was charged, we credit the amount back. Dissatisfaction with the artistic result is not a defect, as the result depends on the description and on the AI model.
9. Liability
We are liable under the applicable statutory rules. Our liability for damage arising from use of the service is limited to the amount you paid in the last 12 months; this does not apply to intent, personal injury, or where mandatory law provides otherwise. Consumer rights remain unaffected.
10. Changes to these terms
We announce changes by e-mail at least 14 days in advance. If you do not agree, you may delete your account before they take effect and receive a refund of unused credit.
11. Governing law
Polish law applies. For consumers this does not affect the protection of mandatory provisions of their country of habitual residence.
